Afterword provides:

  • AI-enhanced journaling
  • Voice transcription
  • AI-generated summaries and reflections
  • Semantic search chat
  • Optional cloud synchronization
  • Credit-based usage system

The Service uses third-party AI providers to generate content.

We may modify, suspend, or discontinue any feature at any time.

3. AI Output Disclaimer

The Service generates content using artificial intelligence.

You acknowledge and agree:

  • AI-generated content may be inaccurate, incomplete, or misleading.
  • The Service does not provide medical, legal, therapeutic, financial, or professional advice.
  • You are solely responsible for decisions made based on AI output.
  • The Service does not replace licensed professionals.
  • Use at your own risk.

4. No Professional Advice

The Service is for informational and personal journaling purposes only.

It is not:

  • Medical advice
  • Psychological counseling
  • Legal advice
  • Financial advice

If you are experiencing distress or crisis, contact appropriate emergency or professional services.

5. User Content

You retain ownership of your content.

You grant us a limited license to:

  • Process
  • Store
  • Transmit
  • Encrypt
  • Analyze (via AI providers)

We do not claim ownership of your content.

You are responsible for ensuring you have rights to all submitted content.

6. Privacy

Your use of the Service is governed by our Privacy Policy.

You acknowledge that:

  • Content may be processed by third-party AI providers.
  • While encryption measures are implemented, no system is completely secure.
  • We are not liable for unauthorized access beyond our reasonable control.

7. Credits and Usage Limits

The Service operates on a credit-based usage model.

  • Credits are consumed by AI features.
  • Credits reset monthly (if applicable).
  • Unused credits may not roll over unless explicitly stated.
  • Credits have no cash value.
  • Credits are non-refundable unless required by law.
  • We reserve the right to modify credit pricing and limits.

8. Subscriptions

If you purchase a subscription:

  • Billing is handled through the applicable platform (e.g., Apple App Store).
  • Subscriptions automatically renew unless canceled.
  • Refunds are governed by the platform’s policies.
  • We are not responsible for third-party billing errors.

9. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes.
  • Attempt to bypass usage limits or throttles.
  • Automate usage beyond intended human interaction.
  • Reverse engineer the Service.
  • Abuse, harass, or harm others using the Service.
  • Upload malicious code.

We may suspend or terminate accounts for violations.

10. Account Suspension and Termination

We may suspend or terminate accounts:

  • For violations of these Terms.
  • For fraud or abuse.
  • For excessive or automated usage.
  • To comply with legal obligations.

We may do so without prior notice.

11. Service Availability

The Service is provided “as is” and “as available.”

We do not guarantee:

  • Continuous availability
  • Error-free operation
  • Accuracy of AI outputs

We are not liable for downtime, interruptions, or data loss.

12. Limitation of Liability

To the maximum extent permitted by law:

Unthinking AI, LLC and its owners shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Emotional distress
  • Lost profits
  • Data loss
  • Decisions made based on AI output

Total liability shall not exceed the greater of:

  • $100 USD
  • OR the amount paid by you in the preceding 12 months.

Some jurisdictions do not allow certain limitations.

13. Indemnification

You agree to indemnify and hold harmless Unthinking AI, LLC from:

  • Claims arising from your content
  • Violations of these Terms
  • Misuse of the Service
  • Infringement of third-party rights

14. Intellectual Property

The Service, including software, design, and branding, is owned by Unthinking AI, LLC.

You may not copy, distribute, or modify the Service without permission.

15. Arbitration and Class Action Waiver

Any disputes shall be resolved through binding arbitration.

You waive the right to:

  • Jury trial
  • Class action lawsuits

Arbitration shall occur in the State of Delaware, unless otherwise required by law.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

17. Changes to Terms

We may update these Terms at any time.

Continued use of the Service after changes constitutes acceptance.

We may require re-acceptance for material changes.

18. Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and Unthinking AI, LLC regarding the Service.
